Enact legislation to strengthen capacity, independence, and procedures in line with the EC's constitutional mandate. The law should empower the EC to issue in a timely manner, binding regulatory instruments with clear provisions for enforcement and to develop and codify internal procedures

EC was established under the 19th amendment to the constituion but Parliament has not yet passed a law clarifying EC’s constitutional powers which has limited its capacity to issue regulations to fully enforce its mandate, including to ensure a level playing field for all political parties affecting its mandate of conducting free and fair elections. For instance, it does not have the power to publicise an election calendar through which either the election date or time period for holding elections can be set. It does not have the power to directly initiate litigation. Also, there is a lack of codified procedures to reinforce transparency in decision-making processes at various stages. Orders connected to the presidential election were issued by the EC through Extraordinary Gazette Notification of 2141/25 dated September 18, 2019.
